Legal Question in Sexual Harassment in New York

Falsely accused of sexually harassment

I travel to several physicians' offices and take care of their medical records releases. The company I am employed by a copany which located in MA.

A woman at a facility I tend to twice a week went to her HR and said that I had aked her out. The facility informed my company that they did not want me back there. My company complied.

I did not say this to this woman. Nor have I made any other comments, suggestions or innuendos to her. This did not happen. I am also a woman by the way and I am not gay.

I believe that I allowed due process and this has been taken from me. I am afraid that my company may decide to use this as either a punative measure or terminate me. I have an at-will contract with them. What are my options? I have been slandered and I am very angry about it.

1- Ask your company - HR Administrator or your supervisor - for the paper work pertaining to the determination to no longer have you service that physician's office. See if there is anything in writing from the complaining person. See what the company used to determine to stop sending you to the physician's office, if there was a statement by someone in the physician's office about what the complainant said.

You can ask the Company for a hearing on the issue, or ask them to put in your file the fact that they made this determination without a hearing, without an investigation, and without even asking you about the incident.

If what is in your file about this incident is false, and you have been financially damaged by this person's unfounded complaint you may wish to take this further into a legal arena.
