Legal Question in Sexual Harassment in New York
Inappropriate Comments
Hello,
My girlfriend works at a restaurant. I found out recently that her supervisor has made THREE inappropriate comments to her. He has met me, and knows we are in a serious relationship. But, has said something about he and my girlfriend ''going on a vacation to the Bahamas'', something about him ''sweeping her off her feet'' (he was holding a broom at the time), and that my girlfriend ''makes him nervous because she likes 'Asian men'''. (I am an Asian American, but *I* don't objectify her as some sexual plaything.)

Re: Inappropriate Comments
Most jurors and judges would not categorize those comments as creating a hostile work environment or soliciting sexual favors via a quid pro quo. However, if your girlfriend (not you) is offended, she should keep a log of the comments with dates and times, and she should complain to human resources or the owner (if it is a private restaurant). If she is terminated or suffers retaliation, your girlfriend may have a good case. If you need further assistance, please copy this reply into any email message you send to me. Good luck!
