It is difficult to answer your question without additional facts. However, as a general matter, an employee who claims to be a victim of sexual harassment is obligated to complain to management unless there is some bona fide reason for not doing so. If an employee who claims to have been harassed fails to avail him or herself to an internal complaint procedure without adequate justificaiton, the company will have a valid defense in any subsequent litigation commenced by the employee.
