Legal Question in Sexual Harassment in New York

if the 34 year old man addmitted to having sex with a 16 year old girl and the girl admitted it to. The girl is not pressing any charges and neither is her family and she has stated that she doesn't want the man to go to jail! what do you think will happen and if he does go to jail how long do you think it will before!

If no one made a complaint, how did the case come to the attention of the police??

The crime you describe appears to be Rape in the third degree a class E Felony it carries a penalty of up to 4 years in jail.

It would be wise for the 34 to have a lawyer and if the 16 year old wants to help him, she should get one too.

Together they can fight the ADA and probably convince him that they will work to defeat him at trial. This will cause a plea bargin at the very least and in some cases an outright dismissal.
