Legal Question in Sexual Harassment in New York

Sexual Harassment towards the Spouse

If a husband is employed & spouse calls / goes to place of employment, and a coworker (female) is always making ''comments'' (ie: ''JIM'S IN THE BACK ROOM WITH JUDY!'') about husband, is this construed as sexual harrasment towards the wife, or the husband, or both? Also, what are the responsibilities of the employer of the husband to ensure that this does not continue? What are the steps the wife (me) can take to ensure this does not continue? Please answer ASAP. Thank you for your time.

Re: Sexual Harassment towards the Spouse

Thank you for your inquiry. This response is for informational purposes only and should not be construed as legal advice.

Your question raises several issues. However, for your purposes, the first step is to simply tell the female employee who is making the comments that you do not appreciate them and ask that she stop immediately.

Whether the behavior you describe is sexual harassment or not would require a lengthy response. However, if the behavior continues after you request that it stop, try taking the matter up with your supervisor/manager and/or her supervisor/manager.

If after these steps are exhausted and the behavior continues, then formalize your complaint under your employer's sexual harassment policy and submit it for review and investigation.

I hope that this has been of some help. Thank you again.
