Legal Question in Sexual Harassment in New York

My 20 yr. old son goes to college in New Hampshire and has been asked by a N.Y. deputy sheriff to return to N.Y. to clear up an accusation by a legal age female. She states my son touched her in a sexual and inappropriate way. He has spoken with the deputy by telephone and has voiced his side of the incident, but has been told by the sheriff to return to N.Y. to clear up the accusation. No official charges have been made. Does he need legal representation?

Absolutely. All it takes to start a criminal action is a person going to a police precinct and filing a complaint. If the Police believe the case is meritorious they can arrest your son. He has already made a mistake by talking to the police. Anything and everything he says may be used against him. Even though your son thinks he may not have said anything injurious, he may have implicated himself to a certain degree. He has no obligation to speak to the police, and until he speaks with an attorney he should not speak with the police.
