Legal Question in Sexual Harassment in New York

sexual misconduct in workplace

I made a report in writing to Management and EEO Office of the Agency where I work about sexual misconduct of my co-worker (intentional touch). After filing report I was involuntary reassigned to another unit. Can I file a law suit?

Did the reassignment have an adverse effect on your employment? If so perhaps.

You can file a lawsuit for retaliation stemming from a complaint related to sexual harassment. However, these cases are very fact specific and you must provide evidence to substantiate the claim and to demonstrate that the decision to demote you was adverse.

I can review this with you in further detail if you would like to contact my office.
