Legal Question in Sexual Harassment in New York

Touched... now feeling guilty

hello, my girlfriend was at the YMCA yesterday working when a man came up and touched her breast and then told her he was a massage artist. she freaked out and called me... she refuses to say anything to management ( the guy is there doing community service)and does not want me to say anything else ( i talked to a low level employee who said she would talk to the guy about wat he did). i need to know if there is any legal action i can take, this has destroyed her and she is a completely different person, i want to make sure this guy can never make another person feel this way.

In order for this to be imputed to her employer as sexual harassment for a lawsuit, the man who touched her needs to have either been a supervisor, or else if it was a customer,

or co-employee, then you need to advise the

YMCA management. If they fail to take any action, then you can report it to the Division of Human Rights or EEOC.

There is also the option of a police report for assault and battery. Was he doing the type of community service that is part of a criminal sentence?
