Legal Question in Social Security Law in New York

disability law

I am thinking of hiring a lawyer to help me file for Social Security disability. My question is if a lawyer receives 25 percent of the back payment wouldn't it be wise to assume that a lawyer would drag his feet in obtaining such benefits? In other words wouldn't he take his time as he could collect more money? I cannot be without some sort of income. I have a family that depends on my income. I own a house and have two children in college and one in a private elementary school. I would appreciate any response to my question. Thank you.

Re: disability law

Attorneys are required by the state bar association to adhere to professional responsibility codes in their areas of legal practice. Albeit, some attorneys do not honor these rules, and often times are cited or disciplined accordingly. However, most attorneys are very ethical period. Further, there is strong incentive for an attorney to have your claim approved by the SSA since that is the only way they would be cleared for fee payment on a contingency basis. So, you would have an attorney with incentive here, and hopefully ethical as well.

While your arithmetic is accurate, note also that the lawyer only gets paid when the claim is approved. There is an incentive to act expeditiously.

I do SSD and I do not make delays to maximize my billings.
