Legal Question in Social Security Law in New York
Social security tax
I am writing because the other day, President Bush stated that
social security will go bankrupt in the next couple of decades. Do I, as a tax payer have the right to sue the US government, to stop them from taking social security tax out of my pay check. If it is not going to be around when I'm ready to collect, then why should I have to pay.

while you have every right to sue, that is not the question. What you mean to ask is whether you have the right to opt out of Social Security and the answer is an unequivocal NO. So any suit you might bring would be quickly dismissed.Social Security is not optional and you would not be the first person to try unsuccesfully to suspend FICA withholding on their earnings.
