As a U.S. based company, do we have to make 30% withholdings on payments made to freelancers based internationally? All of the work is completed internationally, but I'm unclear as to whether it's U.S. sourced income. Also some are sole practitioners. Others are freelancers within larger companies. Are either or both eligible to fill out W-8BEN forms exempting them from withholdings?

Those are great question and as a tax lawyer I'd want to get more details before answering those questions. And these are not the kind of questions you should expect an attorney to answer without compensation. You are running a business and legal and accounting fees are a cost of doing business.
