Legal Question in Tax Law in New York

I have kids but don't live with me but my ex can't clam them cuz he dis't work and he havein he's mom and dad clam them but thay have no rights to them my ex dis what can I do

Is this covered in any Court papers for your divorce. They usually state who may claim them. In absence of this, parent providing more than 1/2 of their support may claim them. If neither parent provides more than 1/2 support, and they live with a relative who provides more than 1/2 of support, that relative may claim them. If in doubt, a Court determination may be required. Differing facts could change this response.
