Legal Question in Traffic Law in New York

1180d

I was stopped at the Triboro trap listed below. On the ticket, the Radar Operator Name is blank. That means it was a visual. It wasn't a bumper pacing technique because he was too far away and accelerating toward me while I was decelerating for my exit (exit 3, first after southbound Triboro to Queens). Is that admissible as an accurate assessment of speed? He put down 70 in a 40.

(Triboro Bridge: On the Queens-bound side, police sit around the curve and at the very end of the bridge waiting for vehicles exceeding the 40 mph limit.)

Is this worth fighting? What can be done?

Fight it simply by appearing and hoping the cop won't, or that the ALJ judging the case knows your cop writes bad tickets all the time. Happens in about 30% to 40% of those cases. A 30MPH speed is big points/money. Possibly insurance consequences too.

Good luck. .

Who's the cop? Some of the TBTA officers are very good at testifying.

The real problem of course is that the matter will go to TVB.

30 over is a 6 point violation, so you will be on the hook for the Driver Responsibility Assessment if found guilty in addition to the fine.
