48 hour parking limit in New York

Recently, my vehicle was towed and

impounded for being parked for over 48

hours in a single space. The parking

space was entirely legal, and the police

dept declared the vehicle abandoned

and hit me with a $250 ticket. Is this

legal?

A car left for more than 48 hours at a legal parking spot may be considered abandonded.

Here is a copy of the applicable law:

� 1224. Abandoned vehicles. 1. A motor vehicle shall be deemed to be

an abandoned vehicle if left unattended

(a) with no number plates affixed thereto, for more than six hours on

any highway or other public place;

(b) for more than twenty-four hours on any highway or other public

place, except a portion of a highway or public place on which parking is

legally permitted;

(c) for more than forty-eight hours, after the parking of such vehicle

shall have become illegal, if left on a portion of a highway or public

place on which parking is legally permitted;

(d) for more than ninety-six hours on property of another if left

without permission of the owner.

Seems you are in violation of NY VTL sec. 1224 (1) (c).
