Legal Question in Traffic Law in New York
7 year old ticket
In 2000, I apparently received two tickets at the same time. One for operating without insurance and the other for disobeyed traf. dev. I have no recollection of this event nor have I received any prior notification until now, which could be the result of moving three times since then. Anyway, now I have to appear in court and don't know what to do about the disobeyed traffic device, I don't even know what that is...can I plead that down? I have proof of insurance for the time of the ticket.

The insurance ticket is very serious. A conviction can lead to a one year revocation of your license, a $100 to $1,000 fine and a $750 civil penalty. You need to fight this ticket vigorously. The insurance ticket is the most important one you need to deal with. The proof of insurnance needed is a letter from the insurance company stating that your insurance was in effect for the vehicle in question on the date in question. An old insurance card will not be enough to get the charge dismissed. As for the failure to obey the traffic control device, that is only a 2 point ticket and the points will not have a serious effect on your drivers license after all of this time since the effect is based upon the date of infraction not the date of conviction. You probably should plea guilty with an explanation and just pay the fine on that one.

The insurance ticket must be contested,inasmuch as the adverse results could be disasterous.A conviction results in a high fine and loss of drivers license and/or privileges to drive in N.Y..I am a former Traffic Court Judge and have extensive experience in this area.
