Legal Question in Traffic Law in New York
Used car scam
I traded a car in to a local used car dealer in 9/04. In 1/05, I began receiving notices of traffic tickets against that car from NY City (Brooklyn). It turns out the salesman at the dealership scammed the dealership and sold the car himself, without removing the registration sticker from the windshield. I convinced the city that the car was traded in last year and they dismissed $3200 worth of tickets, yet I continue to receive notices on other tickets. The dealer has not provided legal assistance. What should I do? How do I remove myself from liability for these charges? Is the dealer responsible for legal fees? Can (or will) the city take action against me at this point?

Re: Used car scam
This problem will not go away. You will be asked to defend these tickets on a regular basis.
There are 2 ways to proceed.
1. The easy way is to go to motor vehicle and disclaim the car. Get your registration revoked. They may not cooperate.
2. The other way is by bringing an action against the car dealership. The remedy you seek is an order from the court to the dealership to (a) find out what happened and (b) take responsibility for the problem by accepting a transfer of ownership to the dealership.
Try motor vehicle and, if they decline to assist you, give me a call and we can come up with a plan to end this problem.
