Legal Question in Traffic Law in New York
''Caught'' speeding
I was ''caught'' going 46 in a 30, and yet I was maybe 30 meters from a 45 mile per hour sign and following a car which was not caught for speeding (even though there were two cop cars). My car was filled with stuff (I was moving back to school) and the cop after asking if I was carrying any drugs or illegal substance, said that he would cut me a break and gave me a Disobeyed Traffic Control Device.
My question is that, should i try to get this removed or reduced? I have had no prior tickets and do not really agree with the ticket nor can i afford the ticket. However I do not want to have to miss class and drive two hours to court if it is futile.

The officer did give you a break. First, 30 meters is in excess of 90 feet, you were in a 30 mile per hour zone. Second, you were to be charged with a 4 point violation. He wrote you for a 2 point violation. If you take the defencive driving course that eliminates the points and nocks off 10% from your auto insurance. Third, if you do want to fight it you can hire an attorney who, in most jurisdictions can appear for you with out you being there.
