Legal Question in Traffic Law in New York
deficient traffic tickets
I received a traffic summons for not wearing a seat belt. The license plate number was omitted on the summons, along with the type of vehicle. Can this ticket be dismissed for being insufficient?

If the ticket were a parking ticket the answer would be yes.A seatbelt however is a moving violation for which you have the right and opportunity to confront and crossexamine the police officer and therefore those errors mentioned are ministerial and do not require a dismissal.If you want to discuss this more you may contact me @718-834-0087.By the way I am a former Traffic Court Judge.
