Legal Question in Traffic Law in New York

Failed to Yeild ROW in Intersection

I was turning left from a side street. There was a light about 100 feet to my right. The light was red. Traffic started to line up. A lady in a truck stopped before my intersection and waved me out. I pulled out far enough that I wasn't accross the yellow line but was still able to see that nothing was coming. As i looked back to my left an suv passed the truck and smashed into my front bumper. I was ticketed as the title says. She didn't recieve anything even though she crossed a double solid line and was illegally passing in a work zone. What should I do? I don't feel that I was at fault because I had already cleared the intersection. She was entering a turn lane for that light but was doing so before the start of the turn lane.

Re: Failed to Yeild ROW in Intersection

We recommend pleading not guilty and fighting the ticket. If you do not want to go to court, we can go for you. On a case like this, we usually are able to get our clients 0 points (unless this ticket was issued in NYC, Suffolk, Rochester or Buffalo). Feel free to email me at [email protected] or visit our web site at www.nytrafficticket.com

Thanks

You have a question of fact to be decided by a judge at trial. Do you have witnesses? Where did this occur? These are important elements in deciding how to proceed. In most jurisdictions it is your word against that of the PO.I am a retired Traffic Court Judge and I will be happy to offer a free phone consultation. The # is 7188340087
