Legal Question in Traffic Law in New York

Fighting a parking ticket

I am a private citizen and recently bought a new car.

In an attempt to sell my previous vehicle I parked it on

a local street with a FOR SALE sign in the window.

I received a ticket which cited NYS vehicle and traffic law

1203 D1. This section reads: ''No person regularly engaged

in the sale or repair of vehicles shall park a vehicle on

any highway for the purpose of displaying such a vehicle for

sale''. My plan is contend that since I do not ''regularly engage in the sale or repair of vehicles'', I should not have been ticketed. Is this a good defense? Also, where can I locate a legally solid definition of the word ''regularly''?

Re: Fighting a parking ticket

This is a simple case. Go to a DMV 'Hearing Center' or return the summons to the City of NY 'Hearing By Mail' address in brooklyn with the following information:

1) a statement that you have only one car for sale and have not had any other car for sale in the last 5 years.

2) some description or evidence of your career/job with a paycheck stub included.

that should be enough. Contact me if you need further assitance.
