Legal Question in Traffic Law in New York
head on collision DWI
While driving, a drunk driver had a head on collision with another driver, The drunk driver swirved into the other lane. Both parties where issued tickets. Party (a) the drunk driver had narcotics and paraphanelia in her car.
Party (b) the victim had no license and an open container that belonged to the passenger.
The victim has tickets for unlicensed driver sewcond offense and DWI but did not drink my question is what is the best defense for the victim?
