Legal Question in Traffic Law in New York
improper use of cell phone
I got pulled over in New York for using a hand held Blackberry in one hand with speaker on, not that I was holding it closer to my ear. The officer issued me a ticket with a fine of 130$ and told me that I cannot hold the device in one hand, I should use a hands free device instead. Can I get the authorities to dismiss the ticket in any way ?

Under New York State Law, you can not hold the phone in anyway when driving.
