Legal Question in Traffic Law in New York
Hi I have a legal question regarding dui/drugs.I fell asleep at the wheel early friday morning ib the middle of an intersection. I woke up in the hospital handcuffed to the bed. they performed blood work, I was unconscience for about 6 hours. I was overtired and took 2 ambier and a seroquel, I remember dropping my daughter off at school and then got very confused and fell asleep at the wheel. The towing company tells me they had to unlock the doors to get me out and i was transported to the hospital and then released. I am afraid they will charge me this week . Can they come and arrest me after the fact.

Yes, they may be waiting for the results of the blood or a urine test. There have been a few cases documented of people driving on ambien and being arrested for driving under the influence of drugs ( you can search the internet). It is a somewhat new and interseting area of the DWI law. You should contact an attorney pre-arrest for advice i ncase you are arrested or questioned. Good Luck.
