Legal Question in Traffic Law in New York
I have a michigan license and was ticketed in NYC for 75 in a 50 zone. The zone is actually a 55 zone. There are a couple of other possible errors on the ticket. In addition the cop pulled me over in a pretty reckless way. Can i fight this?

This is a 6-point ticket that carries roughly a $200 fine plus a $300 Driver Assessment Fee and, if you are convicted and have other recent convictions, can lead to a suspension of your driving license or privileges. It can also adversely affect your insurance rates. We, therefore, highly recommend that you plead not guilty and fight this ticket. This the only way to possibly save points, money and avoid a possible insurance increase.
BTW, in NYC, there are no such thing as a 55 mph limit. The maximum speed limit in NYC is 50 mph.
Also, points from a New York conviction WILL transfer to your Michigan license. The Michigan DMV will assess the amount of points that would have been assessed if the violation occurred in Michigan. We therefore recommend that you fight this ticket. Further, the conviction will be reported to the Michigan DMV and therefore your insurance company can learn about it.
Finally, in my experience, NY traffic judges will deem as irrelevant the manner in which the officer pulled you over. Instead, they are primarily interested in whether you were speeding (or not).
