Legal Question in Traffic Law in New York

No NYS Insurance ticket in NJ

I was pulled over in NJ for speeding and learned that my license and registration were under suspension for no liability insurance. I turned in my plates, paid the termination fee for suspension, which terminates in October, and took my car off the road. I recently moved to NJ and was not contacted by my insurance company about being dropped. It wasn't until I was pulled over that I realized my license was suspended. Now the NJ courts are telling me that I can lose my license for an additional year. Can NJ suspend a NY license? Is there any recourse? What is the best course of action? Thanks

You can be suspended in NJ for the situation you describe in your letter. However, if it can be proven that you did not have proper notice that your insurance was cancelled and/or that your license was suspended, there may be a way to beat these tickets. A conviction for driving with no insurance in NJ automatically results in a one year loss of your license. I am an attorney who has handled many cases similar to yours in various courts in NJ in the past. Please call me at 908-272-0111 to discuss your case in more detail. There is never any charge for simply talking to me about a case. Thank you.

New Jersey can not suspend your New York driving license. It can suspend your privilege of operating a vehicle in New Jersey. A lack of knowledge about the lack of insurance is a defense, but even if you knew, the New Jersey law which requires motor vehicle insurance applies only to vehicles principally garaged in New Jersey. Lack of notice of a driving suspension is also a defense available to you. The State must prove, beyond a reasonable doubt, that a notice of your suspension was mailed to you at the address which New York Motor Vehicles had for you before the offense date, with sufficient time to be received by you in the mail.

Yes, a NJ court or NJ MVS can stop you from using the NJ roads with your NY license, if it is done properly. You need an attorney, it seems. License suspension, and driving while suspended are very serious problems in NJ.
