Legal Question in Traffic Law in New York
Is a NYS State trooper exempt from speeding posted limit in a non emergency situation. I followed a trooper into the fast lane to overtake and pass someone doing less than the limit or just at the limit, stayed behind the trooper, pulled back over just behind her and she gave me a speeding ticket for 78 in a 65 mph zone. She stated in an emergency vehicle she is exempt from posted speed limits even in a non emergency situation. At no point was I going faster than she was, I was behind her passing the slow car the entire way. And pulled in behind her. Then she flipped the lights on and proceeded to give me a ticket for speeding. Is this legal? Is she right?
