Legal Question in Traffic Law in New York
Overdue Deposition
After requesting a supporting deposition using a court supplied form, requested from and left with the court, on the first appearence for a suspened licence ticket, the deposition has yet to arrive.The request was hand delivered to the clerks office on Aug. 9,2004. I have asked for several continuances wanting to see the deposition before deciding on a course of action. The date is now Jan.2005 and I believe there is a time limit on a depositons arrival. Am I correct? If so, do I ask the Judge for a dismissal for this cause at my next court appearance?
