Legal Question in Traffic Law in New York

parking lot hit and run

pedestrian hit and run in a parking lot. Car stuck shopping cart, in which my 2 month old daughter was in. Police caught the lady and couldn't arrest her because it occured on private property. (Target parkinglot)

Is there any charges we can press against her? Or would target have to press them. Whole incident on tape.

You could bring a civil lawsuit against the driver (and owner of the car if it is owned by someone else). Whether it makes sense to do so depends on whether or not your child was injured. New York State law requires "serious injury" in cases involving a car. If you believe that your child was injured you can call me to discuss the case. My number is 212-622-7180.
