Legal Question in Traffic Law in New York

points on driving record

I am 22 with no points on my record and I recieved a speeding ticket a month ago that put 6 points on my licens. I recieved another one today that put another 6 points on, total of 12. I pleaded guilty to the first one and paid the fine and am not sure what my next step should be. I cannot lose my license. Will taking a defensive driving course this weekend prevent that? Is it too late? What should my next step be. Thanks.

Re: points on driving record

Do not take the defensive course until after you plead in court otherwise it will not count. Sounds strange but true.

Further, do not plead guilty to new ticket. Go to court and meet with officer or town attorney and they usually will allow you to plead to a lower "point" offense.

Of course if you were doing 80 in a school zone, etc. they might not but you have nothing to lose.

I suggest you hire an attorney to do this for you as you do NOT want 12 pts on your license. Whatever the fee is will be well worth it (aprox $400-600).

DO NOT ENTER A PLEA OF GUILTY.Plead not guilty and explore your defenses with an experienced Traffic Violation defense attorney. In some jurisdictions you may have the option to plea bargain. Please contact my office for a free phone consultation.

Actually, you do want to take the class BEFORE you finalize your case. Enter a plea of not guilty and take the driver safety class as soon as possible. I hate to contradict another attorney but having done this type of work for 17 years, I am confident that you will get the credit for it and will maximize your chance of avoiding a suspension. You need to fight this case. How depends on the court. Feel free to call us or fax us the front of your ticket with a return phone number. Thanks
