Legal Question in Traffic Law in New York
I just got pulled over the other day and was told my liscense is suspended. When I called dmv they told me it was because I failed to pay a fee for having points on my liscense. I know I payed it and mailed it out. I contacted my old bank and because I haven't been with them for almost 2 years they no longer have my records on file. Now I payed this fee well over a year ago and they just suspended it this past July2009. I do not know what to do. I know I paid it and my husband remembers me paying it also.

You probably paid the ticket fee to DMV. However, once the ticket went into suspension, there was a suspension lift fee that is imoposed. (usually 35 dollars if paid immediately and it goes up. It's simply a way to make DMV more money). This was probably not paid. It is separate from the ticket fee. Therefore, your license or privilege to drive remained suspended. If they issued you a ticket for driving with a suspended license, it is a criminal charge. A misdemeanor. If you run a DMV abstract of your license you should be able to determine the cause of the outstanding suspension. Please feel free to call if you need further assistance. Good Luck.
