Legal Question in Traffic Law in New York
Questionable Radar Use By Police
I was driving on a State Rt. in New York and a cop was driving in the opposite direction, towards me. He used his radar gun to clock my speed, but as I mentioned he was driving towards me at speeds near 55 mph. Is this legal? Can a police officer get an accurate reading of my speed while also driving?

Re: Questionable Radar Use By Police
Police Dopler radar can track a vehicle's speed in either direction. The radar unit uses a comparison between the speed of the vehcile against a non-moving point and the speed of a vehicle traveling in an opposite direction - thus giving an accurate speed to + or - 1 mph. This type of radar track is called "moving radar" and has been given Judicial Notice.
