Legal Question in Traffic Law in New York
Requesting Traffic School
Hi.
I live in the state of NY where the max speed is only 55mph. I was traveling on the ocean parkway at 90mph and received a speeding ticket.
On the ticket it appeared to everyone that the cop put the wrong time, but after going to court and printing the ticket out it was the correct time. Unfortunately I had already put in the not guilty plea. My question is this, since I was traveling at 30+ and this is my first ticket is there any way of getting out of this with some traffic classes without changing my plea to guilty?
I am also out of state for this so I have to write to the judge with a ''affidavit in lieu appearance''.
Should I request another hearing in person if it will be more effective when I return?
How should I write out this request?
It was also due in their hands by the 30th of this month so will a few days late be a big deal?
Are the fines lesser with this method?
Many thanks for this free legal advice.

Re: Requesting Traffic School
1. 30 over is a big deal. You are not going to just walk away from this ticket so your best chance is getting a lawyer. It shouldn't cost more than 1k and a lawyer can save you a lot of money on fines and in insurance increases.
2. Send the letter RRR and then get into the courthouse. You were supposed to act before the 30th, the court may have suspended your license and driving privileges because you didn't appear. Again hire a lawyer and he can appear for you and make sure you don't miss an appearance again.
3.Fines will not be affected except you are proving to the court that you may not be responsible enough to have driving privileges.
If you decide to get an attorney, you may contact me through the links below. Whether or not you contact me however you really need a lawyer.
Good Luck, you're going to need it.
