Legal Question in Traffic Law in New York

snow removal

Is it illegal in NYS to take snow

off of your property and dump

it along side your neighbors

property line and on their

property, therefore creating

runoff in the spring and water

in the cellar. It is also being

pushed by a snowplow on the

neighbors truck, then lifted high

onto snowbanks with his front

end loader, onto mine and town

owned road. Town is afraid of him

and will not give me the local

law about this. I listed it under

Traffice Law because a Town Road

is used in this. Once he leaves his

driveway, he is on Town Road

It is not illegal in my opinion unless he makes a serious hazard for drivers or the road. As for your cellar you can use tresspass laws and/or sue him for creating a nuisance to you and your property. You could also sue him under negligence concepts. You should contact an attorney in your area for assistance.
