Speeding ticket in NY State

I recently was charged with 81/55mph (radar) on I-84 while traveling through upstate NY. This occurred at rush hour on a weekday morning. I have plead not guilty, and feel that I was incorrectly charged. I was driving with the flow, and traffic was NOT doing 80. What is a good strategy to get this corrected?

Whether it is a relative or a new client, I always suggest getting an attorney to aid in the process of working with the local DA and justice court to come up with a successful resolution. That always seems to get the best result. Either way, you should contact the local justice court where you will need to appear and ask them what steps are needed. Most courts have specific instructions, i.e. forwarding a copy of the ticket, an abstract of your driving record, etc. Once they tell you what to provide, I would then write a letter enclosing those documents, and then explain as you did in your question the circumstances of your ticket � emphasizing the flow of traffic, no accident, etc. That always helps.

Pleading not guilty and requesting a hearing is always recommended. Whether the police officer doesn't appear or appears but is willing to reduce the speed to change the type of offense, the driver can benefit by having a hearing.

Hiring an experienced traffic attoreny in the area that undersands the use of radar, its accuracy, and the certifications required to use it properly is vital to not only trying to win, but to keep your insuarnce premiums lower for years to come. PAyign a little today may save you two or three times in the future.
