Legal Question in Traffic Law in New York
speeding ticket
Can a trooper record my deposition without informing me he is taking it? I was asked the ''usual'' trooper speeding questions, ''Do you know why I stopped you? Do you know how fast you were going?'' I answered, not realizing those would be part of the deposition on my ticket. Also, the date he recorded for my inspection expiration makes it appear as though my inspection is expired (which is is not). Thanks for any help!!

Any statements you make to the trooper can and will be used against you.If you want to discuss the specifics of your case you may call my office @7188340087 for a free phone consultation.
Re: speeding ticket
The trooper wasn't making a deposition for you, he was making one for himself and he was questioning you. Since you were not under arrest these questions were not a product of an unlawful arrest/ interrogation.
You are best to give no more than your name, address and license and say nothing more. Anything you say can and will be used against you.
If you want some help with these tickets you can contact my office by sending an note in the links below.
