Legal Question in Traffic Law in New York

Statute of limitations of out of state speeding ticket

I live in CT. and I received a speeding ticket in NYS in 2001. Not realizing my licensee had a previous address the ticket was written up with that incorrect address. I did not hear anything from the NYS courts and I just never took any action on paying the ticket. AT times I do drive through NYS in order to get to PA. My question is , is there a statute of limitations in NYS on if I get pulled over that the ticket I received in 2001 will be off the records and I will not have to go through a big hassle? If there is a statute what is the number of years that have to pass?

Re: Statute of limitations of out of state speeding ticket

The statute of limitations is not the issue. increasingly, states are linking up their systems. You could get your CT license suspended through this ticket.

In addition, it is likely that your right to drive in NY on yoiur CT license has been suspended and, if you are stopped, you will be charged with driving on a suspended license, a class E felony. You will spend the night in jail.

As you can see, I strongly recommend addressing these tickets. It is not my style to scare people (check on my other responses), but these are the facts.

You are welcome to a consultation for no fee.

Re: Statute of limitations of out of state speeding ticket

There is no statute of limitations for a speeding charge. Failure to answer results in a suspension of one's license or privilege to drive in N.Y. Furthermore should you be stopped you are subject to arrest. Your Connecticut license may also be suspended for this failure to respond to the summons. You should resolve this as quickly as possible. If you call my office with more details it may be possible to resolve this without you even appearing in N.Y. My office number is 718-834-0087.
