Legal Question in Traffic Law in New York
ticket
I got a cell phone ticket in febuary at 6:10pm when i wasnt on it. When i got my phone bill it indicated that my last phone call was at 6:06 pm and i was still at work at this time. I am taking this to court. Will I be able to beat this case? I wasn't even on my cell phone.

Re: ticket
It depends on the county that the ticket was issued in, the court that the case will be heard in and the police officer that testifies. Evidence of the cell phone bill will be persuasive but not absolute since you could have been on another cell phone. You may want to consult an attorney. Cell phone ticket do not carry points but since they are considered moving violations, your insurance company can surcharge you in some cases.
