Traffic tickets

Who is responsible for summons received while driving a company owned vehicle? The owner or the driver? What responsibilities does the company owner have to maintain vehicle safety? Lights, tires, fire extinguisher, etc?

Generally, the individual to whom the summons is issued is the responsible party. However, if a driver is issued a ticket for his company's unsafe vehicle, a corporate substitution is usually done. We do this all the time for our clients. I recommend speaking to your employer about the situation and see if they will retain an attorney who will arrange for the substitution. Hope this helps.

Responsibility generally runs with who is cited on the summons. If the tickets are written against the company, the driver is off the hook; if they are written in the driver's name, the driver is responsible.

Exceptions include overweight violations (against registered owner) and moving violations/license issues (against driver).

A commercial driver is required to make a pre-trip inspection of the vehicle- they are not supposed to blindly rely upon the vehicle's owner.
