Legal Question in Traffic Law in New York

uninsured vehicle

I got a ticket for not having insurance on my car about 2 years ago. I never paid the ticket and now need to go to court to pay the ticket and have my license renewed. I made a mistake in not making sure my car had insurance I just want to fix it. Do I need a laywer to go with me to court or can I do it myself?

You should consult with an attorney familiar with VTL, the TVB and the courts and then decide if you need representation.

A ticket for no insurance, VTL section 319.1 has some very nasty consequences. First is that failure to prove that you had insurance on a vehicle in New York State brings a manditory 1 year suspension of your divers license and it is not at the discretion of the court, it is statutory and at the control of the department of motor vehicles. I suggest that you contact an attorney experienced in vehicle and traffic law to determine your best course of action if there is one.

While you can always "do it yourself" would you operate on yourself??

Look it is no joke that traffic courts are not the fairest places in the world. The court procedures favor the police and the DMV. You could lose your license to drive for a long time. How will that effect your livelihood? I notice a Long Island zip code. How will you get around on an island that does not have sufficient mass transit?

A lawyer could cost you over $1500 in a case like yours. How much will it cost not to have one?

If you should decide to move on your own, I suggest you go to the court and watch a trial or two before your court date. That ought to scare you enough to have you run to a lawyer.

I need more information before answering. If you did not own the car you have a defense, if perhaps the car was insured then you definately have a defense. The possible penalties are a fine and loss of license for 1 year. There is no descretion. A restricted license may be obtained to allow travel for employment.
