Legal Question in Traffic Law in New York

wrongful speeding ticket?

I was issued a speeding ticket for doing 50 in a 35 MPH zone. The problem is that I had not yet entered into the 35 MPH zone. I had just passed a speed zone ahead sign and had not even come into view of a 35 sign when the officer was passing me (comming from the opposite direction)and turned on her lights. I pulled over 2/10 of a mile before first 35MPH sign. Is there any way to prove that I did nothing wrong? I only have my 8 year old son to verify where we were stopped and the fact that the officer pointed to the 35 sign when she stopped me. Thanks

Re: wrongful speeding ticket?

Your only proof will be your own word. Go take pictures of the zone in question to show the judge.

How did the officer Judge your speed? Radar? You need to know.

If you are pleading not guilty, request a supporting deposition from the officer. You usually request this on back of ticket. If it is not given to you, the ticket will be dismissed.

Re: wrongful speeding ticket?

I need to know where this incident took place before offering specific advise. I would however suggest that you take photos of the area in question ,they will be helpful at trial for illustration and cross-examination purposes.I really need more facts before any further advise can be offered. You may call my office @ 7188340087 for a free phone consultation.
