Legal Question in Wills and Trusts in New York
About 15 years ago my father who is now 85, gave all his childern a copy of the family will. My sister and her husband and two children have been living with my parents for almost 18 years now. My parents are old and I am noticing more and more just how much influence by my sister and her husband have over my parents. Both my brother and myself are becoming very much concerned about this influence. We would like to find out if the will we have is good or has there been another will made and if so would it be possible to view it??

The will is a confidential document. You may view it only with your father's permission.
I agree. However, many years have passed and different facts and circumstances may exist today. Certainly parents who live with children are subjected to their influence. In most states, this influence cannot be contested until after a Will has been probated, which means after someone has died. .You do not say anything about who is the primary caregiver to your parents, you and/or your siblings. You do not say anything about who contributes to the costs of running the house, who may handle day-to-day financial affairs, etc. Further, you do not say anything about your parents physical and/or mental health. All of these factors bear upon what influence may being exerted (good or bad), what funds and whose are being expended. All of this bears upon your concerns.
