Legal Question in Wills and Trusts in New York
After 40 years a man called our house and wanted my husband to take a dna test to see if he is his biological father as his mother was killed in a car accident and he was put up for adoption when he was born. He was adopoted and had a very good life and then his adopted parents died 2 years ago.
He found his Mothers family and serched for his fathers. He was told it could be my husbands brother and then my mother inlaw said it could be my husband? His Sisters also wrote it on the internet about this. My husband did a DNA and we are waiting for the results? How do we protect our Estate as we have 3 childern and grandchildern. Can I bring a suite aganist my inlaws for slander?

Q. How do we protect our Estate as we have 3 childern and grandchildern.
A. You may protect your estate by having your husband prepare and sign a will. I would also suggest a family tree that includes the possible illegitimate child.
Q. Can I bring a suite aganist my inlaws for slander?
A. If your mother-in-law rendered an opinion or a guess "it could be my husband" instead of a fact "it is your husband", you would not have an action for slander if the DNA report turns out negative.
