Access to Save Deposit Box

Can I, if I have a durable blanket POA, gain access to my uncle's safe deposit box either now or after his death? I have no signature registered with bank on his box. He is getting worse in demensia, etc.

Ifthe POA allows you to access bank docs, you should be able to do so before death, but not afterwards.

Should you like to discuss this or any other legal matter you can e-mail me for more information about low cost face-to-face, on-line or a telephone consultation with a lawyer in our office.

A power of attorney, even if durable ends upon death.

If the POA is drawn on the correct form, a NYS bank should accept it, but you never know.

Good luck.
