Legal Question in Wills and Trusts in New York
Need advise
My mother does not have alot of money in the bank, but she does own her own home. One of my siblings took money from my mother that he had no right to take. What would be the best way to get this money back upon the death of my mother. Should my mother sign a letter stating she wants this money to be taken out of his share of the home, or does something more legal have to be in place to collect this debt.

Should your mother want these funds deducted from her son's share her best approach would be for you mother to update her will stating her intentions.
