Aunt contesting my fathers will !!!
Yes my Aunt is contesting my fathers will which is 28 million. I am named in the will to get everything and my Aunt isnt named anywhere in the will. I am the only surviving child. My father owned 4 car dealer ships and 4 computer stores and a multi million dollar home. My aunt is claiming she was business partners with my father and said she deserves everything. She isnt even show up at her own brothers funeral. I have proof saying that my father started his business by himself. I have given my aunt 6 months to come up with the proof and my court date is in september and she still hasnt come up with any proof. I am wondering if she doesnt have any proof and had 6 months whats her standing on appealing the judges decision. Also what are her chances of getting anything. Also how long can this be drawn out its been going on since April 2002.

Will contests can take months to resolve. She would need proof of undue duress. Since she would not receive anything were there no will I see little chance for her. Speak with your NY lawyer. Good luck.

The burden will be on you to show that the will was properly executed. She will have the burden of showing that the will is somehow defective or that she has some claim against the estate. I suggest you seek legal representation.
