Legal Question in Wills and Trusts in New York
My biological father died and left a will for his new wife, her kids, and his daughter. We, his biological children, were left out of the will. I was adopted by my stepfather. Can i still get money from the will?
1 Answer from Attorneys
Unless he was incompetent or subject to undue influence, your chances are slim. By being adopted, your ties to your biological father were severed and you were no longer considered one of his legal heirs. If this same situation applies to his other children (they were also adopted), none has a legal entitlement. I would need to see a copy of the Will to respond better. Plus, more information is needed as to your relationship, if any, with him after the adoption. This is a response to an Internet question and the reply is not intended to be legal advice or as creating an attorney-client relationship. The reply is based upon the the facts presented. Different or missing facts could change the response.
