Legal Question in Wills and Trusts in New York

My brother recently passed away and his will his ex wife is named as executor and I (his sister ) is second...she tried to say that it disqualifies her because they are divorced so that means I become executor, is that true?

It depends on the wording of her appointment. However, she certainly can waive her rights in your favor.
