Legal Question in Wills and Trusts in New York

change of will

My husband and I prepared a will in 1987. We have been separated (not legally) since 1990. How can I revise the will?

Re: change of will

You can draft and execute a new will. However, although you may leave your spouse out of the will, he still has a right of election. In other words, a spouse cannot cut out another spouse's right of inheritance for a set sum of money.
