Legal Question in Wills and Trusts in New York
contesting a will
I have before me papers to be signed to close out the estate of my fathers will...their are many issues on the summary that i do not agree with also my sister who is co- executor has things that were suppose to be turned in and a valuable coin collection that she claims as hers when all 7 children on this will including my brother who is the other co- executor know that it was not given to her...also i would like know how much legal time i have to check out this documentation before proceedings begin...the lawyer for the estate told me i have a few days....thanks Ron

Re: contesting a will
Not having seen the Will, my response will be general. If you do not agree with their accounting, and it appears not to agree with what the Will specifies, you do not have to approve it and can petition the Surrogate to compel them to comply with the terms of the Will. If you have other siblings that also disagree, they can join in the petition. Raise all issues with which you disagree. It might be best if you consulted with a NY attorney familiar with Will contests.
