Legal Question in Wills and Trusts in New York

Court Appointment Papers

My uncle deceased some time ago and I was assigned as the executor in his will. I have been told I need court appointment docs/papers in order to retrieve some of his assets. I have the death certificate and will. However, when I try to retrieve it from the probate court, they tell me they are unavailable or have not been filed. How do I resolve this matter?

Something doesn't seem right. The probate department is open each weekday that is not a holiday. They are available you may need an attorney to sort out the problems you are having.

Your question states, "or have not been filed". The documents (will and death certificate) are not filed automatically. The executor or person (lawyer) instructed by the executor must file them.
